AGREEMENT BETWEEN USER AND JOYTRIP ONLINE MARKETING LIMITED
1. Introduction
Welcome to the Joytrip website (the "Website"). The terms "we", "us", "our", and "Joytrip" refer to Joytrip Online Marketing Limited, a company incorporated in Hong Kong with its registered office at Unit 2A, 17/F, Glenealy Tower, No.1 Glenealy, Central, Hong Kong, and registration number (77557521). Access to our website, mobile application, or any other Joytrip platform (collectively, the "Platform") is offered to you conditioned upon your acceptance without modification of all the terms, conditions, and notices set forth below (collectively, the "Terms").
2. Definitions
"Booking": A reservation made through the Joytrip platform.
"Platform": Joytrip’s website, mobile app, and related services.
"Service Provider": Hotels, resorts, or other accommodations listed on the Platform.
3. Scope of Services
Joytrip acts as an intermediary between Users and Service Providers. We facilitate Bookings but do not own, manage, or control the accommodations. All services provided by Service Providers are their sole responsibility.
4. Account Registration
Users may need to create an account to access certain features. You agree to provide accurate information and maintain account security. Joytrip reserves the right to suspend or terminate accounts that violate this Agreement.
5. Access and Use of the Platform
You may use the Platform solely for personal and non-commercial purposes related to making and managing Bookings. You must not misuse, hack, or interfere with the Platform’s functionality. Joytrip may limit or restrict access to the Platform at our discretion, without prior notice.
6. Joytrip Is Not a Travel Product Provider
Joytrip does not provide accommodation or travel services directly. The travel products (rooms, amenities, packages) are offered by independent Service Providers. Joytrip is not responsible for the quality, safety, or legality of services provided by third parties.
7. Use of the Platform
By using the Platform, you agree:
Not to make fraudulent or speculative Bookings.
Not to copy, reproduce, or exploit any part of the Platform without express written permission.
To comply with all applicable laws and the policies of any Service Provider you book through Joytrip.
8. Booking Process
All Bookings are subject to availability and Service Provider confirmation.
Users are responsible for verifying all Booking details (e.g., dates, room type, guest information) before confirming.
9. Payment Terms
Full Payment: Payment is required in full at the time of Booking. Unpaid reservations will be automatically canceled.
Currency & Taxes: Prices are displayed in [HKD/Others]. Taxes and fees are included unless stated otherwise.
10. Cancellation and Amendments
Strict Cancellation Policy:
Non-Refundable Bookings: All Bookings are final. No refunds for cancellations, no-shows, early check-outs, or modifications.
No Amendments: Changes to dates, guest details, or room preferences are strictly prohibited post-confirmation.
No-Show Policy: Failure to check in on the reserved date constitutes a "no-show" and results in cancellation without refund.
Early Check-Out Policy: Guests who leave before the reserved check-out date forfeit any refund or credit.
Force Majeure: Joytrip is not liable for cancellations due to events beyond control (e.g., natural disasters, pandemics). Users are advised to seek coverage through travel insurance.
11. User Obligations
Provide accurate and truthful information.
Comply with all Service Provider rules (e.g., check-in times, ID requirements).
Ensure you have valid travel documents. Joytrip is not responsible for denied entry or stay due to documentation issues.
12. Liability Limitations
Joytrip is not liable for:
Actions or omissions by Service Providers.
Indirect, incidental, or consequential damages related to Platform use.
Total liability is limited to the amount paid for the Booking.
13. Disclaimers
The Platform and services are provided "as is." Joytrip makes no guarantees regarding service availability, accuracy, reliability, or suitability.
14. Intellectual Property
All content on the Platform (e.g., logos, text, graphics) belongs to Joytrip or its licensors. Unauthorized use or duplication is strictly prohibited.
15. Privacy
Your personal information is processed according to our [Privacy Policy] and in compliance with the Hong Kong Personal Data (Privacy) Ordinance (PDPO).
16. Governing Law & Dispute Resolution
Law: This Agreement is governed by the laws of Hong Kong SAR.
Jurisdiction: All disputes shall be resolved exclusively in Hong Kong courts.
17. Changes to the Terms
Joytrip may modify these Terms at any time. Continued use of the Platform after changes are published constitutes your acceptance of the revised Terms. Users are encouraged to check the Terms periodically.
18. General
Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions remain in effect.
Entire Agreement: This Agreement constitutes the entire understanding between you and Joytrip regarding use of the Platform.
